These Terms of Service (“Terms”) govern your access to and use of the HomePortfolio website, applications, APIs and related services (together, the “Service”), operated by HomePortfolio Ltd (“HomePortfolio”, “we”, “us” or “our”). Please read them carefully.

1. Acceptance of these Terms

By accessing or using the Service, creating an account, or subscribing to a paid plan, you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, you must not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of the Service

HomePortfolio provides AI-assisted property intelligence for UK properties, aggregating and analysing data from publicly available sources (such as HM Land Registry, Energy Performance Certificates, planning records, the Office for National Statistics and police.uk) to produce summaries, estimates, scores and insights.

The Service is provided for general information only. It does not constitute financial, investment, mortgage, tax, legal, surveying, conveyancing or valuation advice, and must not be relied upon as such. Outputs are generated using models and third-party data and are not a substitute for professional advice or independent verification. You are solely responsible for any decision you make, and you should obtain appropriate professional advice and conduct your own due diligence before acting.

3. Accounts

Some features require an account. You agree to provide accurate information, to keep your credentials confidential, and to be responsible for all activity under your account. You must notify us promptly at [email protected] if you suspect any unauthorised use. You must be at least 18 years old to create an account and use the Service. We may suspend or terminate accounts that violate these Terms.

4. Subscriptions, billing and refunds

Paid plans are billed through Stripe, our payment processor. By subscribing you authorise us (via Stripe) to charge the applicable fees to your chosen payment method.

• Fees and plans. Current prices and plan features are shown on our pricing page. We may change pricing for future billing periods; any change will not affect the period you have already paid for, and we will give reasonable notice of changes.
• Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or annual, as selected) at the then-current price, unless you cancel before the renewal date.
• Cancellation. You can cancel at any time from your account settings or by contacting us. Cancellation stops future renewals; you retain access to the paid features until the end of the current billing period.
• Refunds. Except where required by law, fees are non-refundable and we do not provide refunds or credits for partial billing periods or unused access. Nothing in these Terms affects your statutory rights as a consumer under UK law.
• Taxes. Fees are exclusive of any applicable taxes unless stated otherwise; you are responsible for any taxes that apply to your purchase.
• Failed payments. If a payment fails, we may retry the charge and may suspend or downgrade paid features until payment is resolved.

5. Acceptable use

You agree that you will not:

• scrape, crawl, harvest, bulk-download, cache or systematically extract data from the Service except through interfaces we expressly provide for that purpose and within their documented limits;
• resell, redistribute, sublicense, publish or otherwise make the Service or its data available to third parties without our prior written permission;
• reverse-engineer, decompile or attempt to derive the source code, models or underlying data structures of the Service, except to the extent this restriction is prohibited by law;
• exceed any rate limits, or circumvent, disable or interfere with security, authentication, metering or access controls;
• use the Service for any unlawful, fraudulent, infringing, harassing or harmful purpose, including any unlawful processing of personal data or any use that breaches the terms of the underlying public data sources;
• introduce malware, attempt to gain unauthorised access to our systems, or interfere with the integrity or performance of the Service;
• use automated means to create accounts or generate excessive load.

We may set and enforce usage limits, and we may monitor use to ensure compliance with these Terms.

6. Intellectual property

The Service, including its software, design, text, graphics, compilations, analyses, scores and other content created by us (but excluding the underlying third-party and public-source data), is owned by or licensed to HomePortfolio and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own internal, lawful purposes. All rights not expressly granted are reserved. The HomePortfolio name and logo are our trademarks and may not be used without our permission.

7. Third-party and public data; accuracy

The Service relies on data from third-party and public sources that we do not control, and on models that produce estimates and scores.

Estimates, valuations, scores, risk indicators and other modelled outputs are approximations and may be incomplete, out of date or inaccurate. Source data may contain errors, gaps or delays, and may be subject to the licence terms of the originating provider. You must independently verify any information before relying on it for any decision. We make no warranty that any output is accurate, current, complete or fit for a particular purpose.

8. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties or conditions of any kind, whether express, implied or statutory, including any implied warranties of satisfactory quality, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free. Nothing in these Terms excludes or limits any rights you have as a consumer that cannot be excluded under applicable law.

9. Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

Subject to the above, and to the fullest extent permitted by law: (a) we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunities, arising out of or relating to your use of, or inability to use, the Service, including any decision made in reliance on its outputs; and (b) our total aggregate liability arising out of or relating to the Service and these Terms will not exceed the greater of (i) the total fees you paid to us in the twelve months before the event giving rise to the claim, or (ii) £100.

10. Indemnity

You agree to indemnify and hold harmless HomePortfolio and its officers, employees and agents from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or related to your misuse of the Service, your breach of these Terms, or your violation of any law or the rights of a third party.

11. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required to comply with the law, or to protect the Service or other users. On termination, the licence granted to you ends and you must stop using the Service. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity and governing law) will survive.

12. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter are governed by the laws of England and Wales. You and we agree to submit to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer you may also be entitled to bring proceedings in the courts of the part of the United Kingdom in which you live.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you should stop using the Service.
